Terms of Service

These terms govern your use of EarthNotes — the EarthNotes mobile apps, earthnotes.ai, and related services (the "Service"), operated by EarthNotes ("we", "us"). By creating an account or using the Service you agree to them. If you use EarthNotes on behalf of a company, you agree on its behalf.

1. Accounts

You need an account to use most of the Service. Keep your sign-in credentials and one-time codes to yourself; you are responsible for activity under your account. Tell us at letsgo@earthnotes.ai if you believe your account has been used without permission.

2. Your content

Notes, files, conversations and other material you add to EarthNotes remain yours. You grant us the licence needed to store, display and share it as the Service is designed to — with your team, and with anyone you share a property or thread with. You are responsible for having the right to share what you share, and for the accuracy of what you post.

3. Acceptable use

Do not use the Service to break the law, to harass or defraud anyone, to send unsolicited messages, to scrape or resell property data, to probe or disrupt our systems, or to upload malware. We may suspend or remove accounts that do.

4. Property data

Parcel, ownership and sales information is compiled from public records and third-party sources and is provided for convenience. It may be incomplete or out of date. Verify it before relying on it for any transaction.

5. SMS program terms

EarthNotes sends text messages to users who opt in through the EarthNotes app or website, or who join a property thread by text. The program sends sign-in verification codes, property shares and invitations, replies in property threads you have joined, and reminders and mentions you set or were tagged in.

• Message frequency varies with your activity — typically 0–10 messages per week in an active property thread, and nothing beyond the sign-in codes you request otherwise.
• Message and data rates may apply.
• To opt out, reply STOP to any message. You will receive one confirmation and no further messages. Reply START to opt back in.
• For help, reply HELP to any message, or contact us at letsgo@earthnotes.ai or earthnotes.ai/support.
• Carriers are not liable for delayed or undelivered messages.
• We do not share your mobile number or opt-in information with third parties or affiliates for marketing or promotional purposes. See our privacy policy and the program description.

Consent to receive text messages is not a condition of purchasing any goods or services.

6. Privacy

How we collect and use information is described in our privacy policy, which is part of these terms.

7. Disclaimers and limitation of liability

The Service is provided "as is". To the fullest extent permitted by law we disclaim all warranties, and we are not liable for indirect, incidental or consequential damages, or for any amount exceeding what you paid us in the twelve months before the claim. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

8. Termination

You can stop using EarthNotes and delete your account at any time (see account deletion). We may suspend or end access for breach of these terms. Sections that by their nature should survive — your content licence for material already shared, disclaimers, limitation of liability — survive termination.

9. Changes

We may update these terms. We will post the new version here with a new date, and for material changes we will notify you in the app or by email. Continued use after the change means you accept it.
